Bulgaria’s Justice Minister, Nadezhda Yordanova, will request the Supreme Judicial Council to remove Ivan Geshev from the post of Chief Prosecutor, the Minister said at a briefing on February 8, hours after the Constitutional Court's decision, which allows such a step to be taken by the Minister of Justice.

The Minister of Justice pointed out that she would seek the removal of Ivan Geshev as Chief Prosecutor by continuing the actions of her previous colleagues and the procedure will begin once the analysis of the actions and inactions of the Chief Prosecutor is complete.

This will be done as soon as possible, the Ministry of Justice specified. The signals against the Chief Prosecutor are currently being analysed and an assesment is being made as to which of them merit reference to the Supreme Judicial Council (SJC).

Last year, the then caretaker Justice Minister Yanaki Stoilov, who is now a constitutional judge, made an attempt for removal of Ivan Geshev from the post of Chief Prosecutor and submitted a request to the SJC.

At the time, the majority of the SJC plenum rejected his request as inadmissible responding that the Justice Minister did not have standing to make such a request, which provoked the Council of Ministers to refer to the Constitutional Court.

Today, the Constitutional Court ruled unanimously that the Minister of Justice can request the early termination of the term of office of the Chief Prosecutor and the Presidents of the Supreme Court of Cassation and the Supreme Administrative Court when there are serious or systematic violations of rights and duties or the prestige of the judiciary is undermined.

Yanaki Stoilov did not participate in the vote of the Constitutional Court.

According to Nadezhda Yordanova, the Court's decision is one of the important guarantees against the encapsulation of the judiciary.

The Justice Minister also said that the Anti-corruption Commission will receive in due time the requested copies of documents related to the signals received in the Ministry regarding alleged irregularities by Chief Prosecutor, Ivan Geshev. According to Nadezhda Yordanova, there is no legal requirement for a minister to appear in person at the anti-corruption commission and retell the content of the signals, and therefore they will be sent in writing.
