As a party to the procedure for the Plenum of the Supreme Judicial Council’s consideration of the proposal of the Minister of Justice for the early dismissal of the Prosecutor General of the Republic of Bulgaria, Mr Ivan Geshev sent a letter to the members of the Plenum for the conduct of a maximum public procedure and discussion on the merits.
The letter states that the signal of the Minister of Justice, Nadezhda Yordanova, shows a deep ignorance of the Constitution and the caretaker Minister of Justice) on the basis of Article 175, paragraph 5 in conjunction with Article 173, para. 3 of the Civil Service Law for early dismissal of the Prosecutor General of the Republic of Bulgaria Ivan Geshev due to the existence of circumstances under Art. 129, par. 3(5) of the Constitution of the Republic of Bulgaria.
In this way, I will have the opportunity, within the framework of an open procedure and with maximum publicity before you and before the Bulgarian society, to take a position on each of the allegations of the Minister of Justice, preceded by daily but absurd attacks in the media, undermining the prestige of the judiciary and violating fundamental European values such as the rule of law and separation of powers.
This is the only legal way in which I could defend not only my honour and dignity, but also that of every prosecutor, from the constant political and media attacks by the executive, which would refute the claims of Minister Yordanova and the executive."
