The Constitutional Court ruled unanimously that the Minister of Justice can request the early termination of the term of office of the Chief Prosecutor and the Presidents of the Supreme court of Cassation and the Supreme Administrative Court.
"The provision of Article 130c of the Constitution also includes the possibility for the Minister of Justice to make a proposal to the Supreme Judicial Council for the early dismissal of the President of the Supreme Court of Cassation, the President of the Supreme Administrative Court and the Prosecutor General in the hypothesis of Article 129(3)(5) of the Constitution," the court's decision said on February 8.
The reasons for the decision are yet to be published.
The Council of Ministers referred to the Constitutional Court after the Supreme Judicial Council refused to consider the proposal by caretaker Justice Minister Prof. Yanaki Stoilov for an early termination of the term of office of Prosecutor General, Ivan Geshev.
Over the past month, Justice Minister Nadezhda Yordanova has repeatedly said that she would initiate a procedure for the early dismissal of Prosecutor General Ivan Geshev in the SJC if the Constitutional Court allowed it.
According to Nadezhda Yordanova, there were signals for various violations by the Prosecutor General, both within the current term of Ivan Geshev and in his previous professional actions.
