On 9th of December, Bulgaria’s Parliament passed at second reading the texts of the draft law on amendments and additions to the Constitution. The amendments foresee division of the Supreme Judicial Council (SJC) into two colleges: a college of judges and a college of prosecutors.
According to the adopted texts, judges, prosecutors and investigators will be appointed, promoted, demoted, transferred or removed from their posts by the two relevant colleges of the SJC.
The lawmakers will next vote to pass the texts on the rules for selection of members and the functions of the two colleges.
According to the Constitution, the SJC consists of 25 members. The Chairperson of the Supreme Court of Cassation, the chairperson of the Supreme Administration Court and the Prosecutor General are its members by law. The remaining 22 members are elected as follows: 11 of the members of the council are elected by the Parliament, and the other 11 members - by the bodies of the judicial system.
According to latest amendments adopted today, 9th of December, the SJC members, which are elected by the Parliament, must receive the support of two thirds of the MPs’ votes in order to be elected.
