The signal that the Minister of Interior, Boyko Rashkov, sent yesterday to the National Investigation Service against Chief Prosecutor, Ivan Geshev, has already been allocated to a prosecutor, the head of the Specialised Prosecutor's office, Valentina Madzharova, said on July 28.
She recalled that Rashkov's data had been forwarded to the Specialised Prosecutor's office and that the signal had been assigned randomly to a prosecutor. He is yet to decide what action to take, on the basis of his inner conviction and the law.
As for Rashkov's statement that he would appeal if it refused to investigate Geshev, Madzharova said the Minister of Interior could do so before the Appellate Specialized Prosecutor's Office. Such is the order and this is how the Prosecutor's office proceeds with all the signals, regardless by whom and against whom they are filed, she added.
Valentina Madzharova recalled that under the 1975 Criminal Procedure Code, the main body authorized to initiate pre-trial proceedings is the prosecutor. Only the 1952 Criminal Procedure Code provided for the possibility for such an assessment to be made by an investigator, in addition to a prosecutor.
The head of the Specialised Prosecutor's office added that over the years there have been various signals against the Chief Prosecutors and this signal is not a precedent. The only difference in this case is that he comes from the caretaker Minister of the Interior.
