More than half of the dams in Bulgaria are in a partial state of disrepair, according to the results of an inspection ordered by the Prosecutor's Office. No one has been punished for unfulfilled recommendations, Deputy Chief Prosecutor Asya Petrova said on 22nd of November. Instead of sanctioning the offenders, new recommendations have been issued, she added.
Nearly 80 dams are in a state of pre-failure. In only 11 cases, the State Agency for Metrology and Technical Surveillance (SAMTS) has attempted to sanctiion the offenders. 205 dams are dangerous for the population. There is a massive failure to comply with the agency's recommendations, the prosecutor's office identified. The reason for not being sanctioned is poor law, and the prosecution does not agree with this. According to Asya Petrova, there are provisions in the Water Act that allow the agency to impose fines.
Only six acts of infringement were issued in respect of the unsafe 200 dams.
After we sought assistance from the Ministry of Economy for the SAMTS inspection in March, we have just received a report from the inspection, Petrova said. In it, however, the ministry supports the agency on the opinion that no enforced measures can be apllied.
According to the prosecution, SAMTS 's actions were severely reprehensible. Repairs to the Beli Iskar dam have not yet begun, although there have been long-established problems. The responsibility for who should make the repairs is allocated between several organisations. That is why, a few days ago, the prosecutor's office called on the state and the municipality to take urgent measures.
A procedure is initiated, which may finish with a fine for the Minister of Regional Development and Public Works for not taking action to repair Beli Iskar dam. The Prosecutor's Office believes that the Energy and Water Regulatory Commission is mistaken that the concessionaire should not invest in the reinforcement of the dam.
