Bulgaria’s President refers to Constitutional Court regarding the role of dedicated prosecutor investigating alleged crimes by Prosecutor General
Only a day after the Law on Amendments to the Penal Procedure Code was promulgated in the State Gazette, Bulgarian President Rumen Radev has asked the Constitutional Court to overturn the amendments, which provide for the appointment of a special prosecutor with powers to investigate any alleged crimes by Prosecutor General and his/her deputies.
President Radev referred to the Constitutional Court asking it to declare the main texts of the law as unconstitutional.
In his request, the President presented the arguments for unconstitutionality of the disputed provisions, which were put forward by him on February 10 this year, in the reasons for the veto of the Law for amendment of the PPC.
The introduction of the post of a special prosecutor to investigate the Prosecutor General or his/her deputy and the transfer of jurisdiction in these cases entirely to the Specialized Criminal Court affect basic constitutional values such as the independence of prosecutors within the judiciary, the principle that all are equal before the law and prohibition. of extraordinary courts.
