Mayor of Septemvri municipality charged with mismanagement

The specialised prosecutor's office on 16^th of April pressed charges against the mayor of Septemvri municipality, Marin Rachev, for deliberate mismanagement (a crime under Article 219, paragraph 3 of the Penal Code) for seven acts, which caused a loss to the municipality amounting to BGN 226 528.24, the prosecution announced on 16^th April.

The indictment concerns the execution of a public procurement contract with the subject: "Repair of road and street network on the territory of Septemvri municipality" concluded between the municipality as contracting authority and "Consortium repairs and restoration-Septemvri" DZZD as a contractor.

The evidence gathered shows that Rachev has made payments under the contract without the construction and installation activities being fulfilled by the builder, and at repeatedly inflated prices.

The materials in this case were separated from the criminal proceedings against Marin Rachev, which was divided because of its huge volume.

The Deputy Mayor of Septemvri Municipality, Yavor Mitev, is also charged with the same offense. He signed an annex to the same contract for the amount of BGN 1,000,000 without the necessity of amending the concluded contract and in order to obtain the benefit for the Consortium repairs and restoration - Septemvri.

Mitev is also accused of not cooperating with the leading investigators against the accused Rachev in the summer of 2018 (as required under Article 155 of the Law on the Judiciary) during the investigations conducted on the territory of the municipality.

Accusations under the pre-trial proceedings have been brought to two more persons - Angel Bonchev, Director of Transport and Environment Directorate in Septemvri Municipality and Stanoi Milov - Investor Control Specialist in Construction Department with directorate "Architecture and Spatial Planning" in the municipality. They are accused of documentary offenses - for having drawn up protocols for completed and payable construction and assembly works on sites under the same contract, provided that these works were either partially executed or totally unfulfilled.

With regard to Rachev and Mitev, measures include money guarantee amounting to BGN 10,000 and to Bonchev and Milov- BGN 5,000.
