The Constitutional Court on May 11 declared as unconstitutional the provisions in the Penal Procedure Code, which introduced the position of a dedicated prosecutor with powers to investigate any alleged crimes by the prosecutor general and his/her deputies. The decision was reached with 11 votes in favour and with a special opinion signed by Filip Dimitrov, the Constitutional Court said.
The position of a dedicated prosecutor was introduced with amendments to the Penal Procedure Code and the Judiciary System Act, tabled by GERB party.
On February 24, 2021, only a day after the Law on Amendments to the Penal Procedure Code was promulgated in the State Gazette, Bulgarian President Rumen Radev asked the Constitutional Court to overturn the amendments and declare them as unconstitutional.
