In connection with an inspection carried out under Article 145 of the Judiciary Act regarding media publications submitted by Prime Minister Kiril Petkov in a total volume of 588 pages, related to 19 persons, on 10.02.2022, the Supreme Cassation Prosecutor's Office (SCPO) requested from the Ministry of Interior and other law enforcement and security agencies, part of the executive branch, full information about the individuals, as well as whether and what actions they have taken against those individuals in accordance with their legal powers, the Prosecutor's Office said on February 22.
At the moment, the Supreme Cassation Prosecutor's Office has received the following amount of information:
Despite the deadline set by the supervising prosecutors to provide the information by 17.02.2022, the information has not yet been received from the directorate for Combating Organised Crime and the National Revenue Agency.
In this regard, reminder letters have been sent to take appropriate action and send the requested information to the SCPO immediately. The institutions have been warned of their liability under Article 405(1) of the Judiciary Act in case of non-compliance with a direction by a prosecutor given under the due order.
Following an analysis of the materials received so far, it is found that there is no information whatsoever regarding some of the persons named by the Prime Minister.
According to the Constitution and the laws of the country, the detection of crimes is the competence of the executive power, in particular of the Ministry of Interior, which should immediately notify the prosecutor's office if evidence of crimes is found.
The lack of information from the Ministry of Interior indicates that they have not taken the legally required actions to detect possible crimes committed by the persons named by Mr. Kiril Petkov, the prosecutor's office said.
