BAILIFFS ENTERED BULGARIA’S TV7 BUILDING

A private bailiff entered the offices of Bulgaria’s TV7 on 29th of April, with a warrant of execution, in relation to a court dispute between the company which owns the TV station and another company, which has claims to the TV channel. Enforcing a court ruling, the private bailiff requested to seize technical equipment of the media.

Bulgaria’s Ministry of Interior (MoI) announced they provided assistance to the activities of the state and private bailiffs in accordance with the requirements of the Civil Procedure Code. MoI told BNT that initially they sent one police team, but because crowds of people built up outside the building of TV7, additional police officers were brought in order to ensure public order and prevent arbitrariness.

The Bulgarian Chamber of Private Enforcement Agents explained that the action was taken in relation to a procedure under the Law on Registered Pledges. The station had not complied with a request to hand over television equipment that had been pledged as a collateral for a loan taken from Corporate Commercial Bank.

The chamber said that because the debt had not been serviced, the station had been asked to hand over the equipment within 14 days. This had not happened, and so the receivers of Corporate Commercial Bank had proceeded to confiscation of the equipment. The private bailiff is Nedelcho Mitev but he was not personally present and sent representatives.

Kristina Dimitrova, which was at the building of the TV station, is the lawyer of the Corporate Commercial Bank receivers and is not a representative of the Chamber of Private Enforcement Agents.

The TV7 journalists made a human chain in front of the building to prevent the seizure of assets and to stop the representatives of the private bailiffs.
